§ 1 - Coverage and Customer Information

The following General Terms and Conditions of Business (hereinafter referred to as GTC) regulate the contractual relation between the Freundeskreis Traditionsarchiv Unterseeboote e. V. – Uboot-Recherche and customers who purchase merchandise through our shop. Conditions contrary to that or deviations from our GTC will not be reckognized by us. The official language is German.

§ 2 - Conclusion of the Contract

(1) The offers in the internet are binding offers made to you to buy goods.

(2) You may put one or several products into the shopping basket. During the ordering process you will enter your data and wishes with regard to the payment methods, shipping arrangements including. Entering your data and clicking on the order button you will accept the offer to conclude a purchase contract. But, you can also enter into the purchase contract by telephone or by fax.

(3) Your order will be accepted and in effect when we have confirmed the receipt of it by E-Mail or telephone. With that a purchasing contract is agreed then. If ordered by phone the purchasing contract will become effective when we clearly accept your order during the conversation. If your order is not accepted by us at once you are not bound by any contract.

§ 3 - Customer information: Storage of your order data

Your order together with details of the concluded contract (such as type of article, price etc.) will be saved by us. However, you will not have access to your previous orders via internet. We will send you the GTC, but you can call them up on our web page, as well. If you want to save the product description, made on our shopping page, for your own purposes, you may make a screenshot (photography of the screen) at the moment of making your order or print the whole page as an alternative.

§ 4 - Customer information: Correction notice

You can correct your input at any moment with the help of the delete key before placing your order. We will inform you about further correction possibilities on the way through the ordering process.

You can also end completely the ordering process, at any moment, by shutting the browser window.

§ 5 - Statute of limitations of your warranty claims

1. Warrenty claims

There are legal rights to warranty claims with regard to our goods.

2. Guaranty for customers when purchasing used goods

Your legal rights to warranty claims with regard to used goods are limited to one year after the hand-over of the goods to you. Exempted from that are any claims for damages and claims arising from defects we concealed fraudulently, and any claims due to warranty we gave for the quality or nature of the merchandise. For these excepted claims statutory periods of limitations will be in force.

3. Guaranty for business representatives

Your legal rights to warranty claims with regard to used goods are limited to one year after the hand-over of potential dangers. Exempted from that are any claims for damages and claims arising from defects we concealed fraudulently, and any claims due to warranty we gave for the quality or nature of the merchandise. Also, any claims in compliance with § 478 of German Civil Code are exempted from that. For these excepted claims statutory periods of limitations will be in force.

§ 6 – Limitation of liability

We exclude liability for slightly negligent breaches of duty, provided they do not refer to substantial contractual obligations, damages arising from offences against life, body or health, warranties or claims in accordance with Product Liability Law. The same is valid for breaches of duty of our agents (communicating agencies) and our legal representatives. Especially the duty to hand over the article to you and to vest you with the property of the merchandise is a part of the substantial contractual obligations. Furthermore we have to procure for you an article free from material deficiencies and defective title.

§ 7 – Legal venue for business representatives

If you deal with us as business representative the legal venue in case of legal disputes is the registered seat of the Freundeskreis Traditionsarchiv Unterseeboote e.V.
